TERMS & CONDITIONS OF SALE
AT ART Global
(hereinafter referred to as “AT”)
1. General Provisions
AT ART Global (“AT”) acts as an independent intermediary and service provider facilitating the sale of paintings and other works of art (the “Paintings”) through online auction portals.
AT does not own, buy or sell the Paintings on its own account.
The Paintings are sold by their respective owners (the “Owners”), and AT assists the Owners in finding purchasers for the Paintings.
By bidding on any Painting offered by AT, the bidder confirms that they have read, understood and agreed to be bound by these Terms & Conditions of Sale.
2. Condition of the Paintings – “As Is”
All Paintings are sold “as is, where is”, with all faults, imperfections and defects.
AT makes no warranties or representations, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, authenticity, authorship, attribution, date of execution, provenance, condition, materials or historical significance.
Any written or oral descriptions, opinions or statements provided by AT or by the Owners are statements of opinion only and shall not be construed as guarantees or warranties of any kind.
Prospective bidders are strongly encouraged to examine the Paintings prior to bidding.
Bidding signifies that the bidder has either examined the Painting to their satisfaction or has chosen not to do so.
If absolute certainty regarding authenticity, provenance or condition is required and such certainty cannot be achieved, bidders are advised not to bid.
3. Information Supplied by Owners
All information concerning the Paintings, including but not limited to the artist’s name, attribution, date, authenticity and provenance, is supplied by the respective Owners.
AT does not verify such information and cannot be held liable for any inaccuracies, omissions or discrepancies contained therein.
4. Role and Liability of AT
AT acts solely as an intermediary between the Owner and the successful bidder (the “Purchaser”).
Under no circumstances shall AT be held responsible or liable for: inaccuracies in descriptions or documentation, the authenticity or provenance of the Paintings, any defects or condition issues, actions or omissions of the Owners or Purchasers.
No statement, whether written or oral, made by AT or by any of its employees shall be deemed a warranty or an assumption of liability.
5. Bidding and Final Sale
All sales are final and irrevocable.
AT does not grant refunds, exchanges or reimbursements.
The successful bidder (Purchaser) undertakes to:
pay the full purchase price,
pay all applicable fees and expenses,
provide accurate shipping and contact information.
Failure to comply with payment obligations may result in cancellation of the sale and reoffering of the Painting without further notice or reserve.
6. Buyer’s Premium
A buyer’s premium is added to the hammer price and forms part of the total purchase price:
25% on the portion of the hammer price up to €50,000.00
23% on the portion from €50,000.01 to €100,000.00
21% on the portion above €100,000.00
7. Packing, Shipping and Risk
Packing and shipping of the Paintings are arranged at the Purchaser’s risk.
All costs related to packing, materials, transport, insurance, customs duties and any other related expenses are borne by the Purchaser and must be paid in full prior to dispatch.
The Painting will not be released or dispatched until the purchase price and all related expenses have been fully settled.
8. Funds Handling
AT acts solely as an intermediary and does not operate as a financial institution.
AT does not hold client funds on a long-term basis.
Payments related to the purchase price of the Paintings are processed via auction platforms or transferred directly between the Purchaser and the Owner, unless otherwise agreed for short-term settlement purposes only.
9. Payments and Cash Policy
All payments must be made via bank transfer or other traceable non-cash payment methods.
AT does not accept cash payments under any circumstances.
10. Origin and Lawful Ownership of Artworks
The Owners declare that they are the lawful owners of the Paintings and that the sale of the Paintings does not violate any applicable laws or regulations.
AT does not knowingly assist in the sale of unlawfully acquired artworks.
11. Compliance and Anti-Money Laundering (AML)
AT applies internal compliance procedures in accordance with applicable anti-money laundering (AML) and related regulations.
Buyers and Sellers may be subject to identification and verification procedures as required by law, auction platforms or internal compliance policies.
AT reserves the right to refuse or discontinue cooperation in cases of insufficient information, suspected unlawful activity or non-compliance with applicable regulations.
12. Sanctions and Regulatory Cooperation
AT conducts its activities in compliance with applicable international sanctions regimes.
AT cooperates with competent authorities, financial institutions and auction platforms in accordance with applicable laws and regulations.
13. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with applicable laws, without prejudice to mandatory consumer protection provisions where applicable.
14. Acceptance of Terms
By bidding on any Painting offered by AT, the bidder confirms acceptance of these Terms & Conditions in their entirety and agrees to be legally bound by them.
